Now any parent can ABDUCT CHILDREN LEGALLY and get instant child custody. As unbelievable as it may sound, a new tactic is being used by hostile/aggressive and mentally unbalanced abducting parents to gain legal advantage. “Safe Haven” states provide INSTANT ORDERS OF PROTECTION complete with INSTANT CHILD CUSTODY ORDERS; no residency is required. Those orders are then given “full faith and credit” throughout the United States.
The stories are nightmarish. Greg Fischer had his children abducted in September 2007. It was a day before primary election day; Mr. Fischer was running for Riverhead Town Board and his children were abducted to Wyoming where “instant child custody” was granted to the abductor. Mr. Fischer sought justice so court papers were filed promptly in Suffolk County, NY. Sadly, the NY Court was fooled by a delusional abducting mother that believed “she was never a New York resident”. As such, New York yielded to the Wyoming courts to decide jurisdiction. Nearly two years have passed and the children are still not returned to their NY citizenship.
There is no New York or Federal Law to protect children from parental abduction or concealment. The proposed I-VAWA Treaty will give those same unjust custody orders legal standing worldwide and give foreign orders power over US children as well.
Mr. Fischer is a popular and nationally known children’s rights advocate and local political figure --- but it is becoming more common, even for elected officials and their families, to experience the evil of child abduction. “Friends are in shock, they think it can’t be true, but within seconds they realize it is a true horror. IT IS A PARENT’S WORST NIGHTMARE and it can happen to any parent” said Mr. Fischer, “my children and I are victims because that there is no Federal Law to prevent abduction and the New York Laws are especially weak among the states.”
Child abduction, especially by a parent, is one of America’s fastest growing crimes with as many as 700,000 abductions forecast --- close to double of recent years. What is causing the increase in abductions? Weak laws, slow, useless and wasteful government processes, and lack of enforcement of existing laws, fuel child abduction.
